Hi Liz-
I was just curious about this company- in your post here back in 2010 you mentioned that it's a good way to have some money trickling in- I was just wondering if you still feel that way. Also, do you feel you might be losing any income due to the creative commons license? Just wondering what your take is.

I'm on the fence about submitting my album.

thanks- your comments would be greatly appreciated :-)

re: This is in regards to a comment from you last year about "performance waivers." I'm surprised you are able to do a "direct license" to a client in the UK. I thought PRS for Music in the UK prohibited direct license deals and required collection of performance royalties for all in-store use of music by themselves directly. Are the tracks on the CDs you send to the home-improvement chain perhaps not registered at any PRO? Or are they registered and you just do a direct license anyhow?

When we license music outside of the USA, and the customer wants a performance waiver, we only provide them music that is either a) not registered with any PRO, or b) registered with an American PRO (ASCAP/BMI).

You are correct that we would not be able to sell a performance waiver from a PRS musician (the UK PRO) to the UK (or any other country except the USA).

However, there is no problem with our selling a PRS signed musician inside the USA. And no problem either with a USA-PRO (ie ASCAP/BMI) musician being sold anywhere.

This slightly complicated, but useful situation exists because the collecting societies in the USA were sued as monopolies, and have to operate in a non-exclusive capacity.

As it happens, PRS in the UK actually called us on this, and I had a meeting with them (and their head lawyer), where they agreed that we were in the right.

We're about to launch a new business called "MoodMixes" which will focus on the background-music-for-shops-and-restaurants field.

I hope that clears things up!

That Creative Commons thing seems fuzzy to me. Is it similar to a non-exclusive deal? Does the writer not get royalties from songs sold through this company?

I am not totally clear on how it works, so I myself would probably stay away from this company. :-[

I don't like that Magnatune uses the Creative Commons scheme to present itself as a "cool" company that somehow doesn't like copyright.

I've had my album on Magnatune for 3 months now and have been very pleased with the exposure it has given me. Additionally, it's always nice to have money trickling in!

My experience is that their communication is top-notch and that their submission process runs smoothly and easily.

The artist profiles are neat too!

re: film/tv placements.

We're very, very strong on the indie film scene, with over 2000 placements in 8 years. We are not strong at all on TV, with less than 20 placements in that time.

Here is a list of some of our placements:
